Pelosi Envisions Prosecution of Bush Officials -- Maybe
In an interview with Rolling Stone magazine posted today, Speaker Nancy Pelosi (D-CA) edges toward endorsing the congressional proposal to create a "truth and reconciliation commission" that would investigate a panoply of misdeeds perpetrated during the Bush years.
When interviewer Tim Dickinson asked if Pelosi could "foresee a scenario in which senior members of the Bush administration are actually prosecuted," she replied:
I think so. The American people deserve answers. Where we are now, in terms of prosecution of White House staff, is that we have charged them with contempt of Congress. We're talking about Harriet Miers, Josh Bolten and Karl Rove. The natural course of events from here is that the speaker will determine what charge we're going to pursue, because there are more than one. Under Bush, the Justice Department told the U.S. attorney not to prosecute the case. So the beat goes on -- it just gets worse. We don't know what will happen, because they've delayed it a long time.
Since being named our Sleeper Bill of the Month six weeks ago, the commission proposal has taken off in a big way. Still, Pelosi notably confined her promised action to the U.S. attorney firings scandal, which has prompted an ongoing contempt-of-Congress tussle with former Bush aides Karl Rove and Harriet Miers.
When Dickinson pressed about abuses of power perpetrated out of the Pentagon rather than the Justice Department, Pelosi demurred:
I didn't like [the Bush administration's] policies, which is why we needed to win the election -- to get them out of power. But I don't know what the evidence is against them on any specific charge. When you have a truth-and-reconciliation commission . . . look, I'm still fighting the bombing of Cambodia. I still have my gripes with the administration that bombed Cambodia before you were born, so I think it's important to bring these things out. If you have a case against someone, you bring a case....
We should have full examination, I'm not denying that. You asked me a specific question: "Should they be charged?" I think that further information might take us to that place, but what we want to do is unify the American people. ... What Mr. Leahy is putting forward, in terms of a truth-and-reconciliation commission, has always been helpful. It was helpful in South Africa, it was helpful in Rwanda, and they were talking about doing it in places like Lebanon. Unfortunately, only the Congress can be responsible for preserving our constitutional prerogatives -- that we get information from the executive branch when we ask for it, that members of the administration appear before us when they are called to the Congress.
Sounds like a Democratic leader pulled in two directions on this question.

Surprisingly, she has put forth a very thoughtful position. Yes, she limited it to the US Atty's firing scandal, but if she were to apply her same logic to rendition, torture, etc., we would be well served.
To talk about proscecutions now in those cases would create a political battle that would go nowhere.... But talking about a Truth Commission keeps the issue from being overly politicized, while still leaving the door open to prosections, depending on how things progress.
I'm encouraged by the quotes reprinted here, and look forward to reading the rest.

That's not the point. This is about whether this country actually believes in the rule of law and acts accordingly. The American people deserve more than just answers.

And last time I checked, the United States Government had no role in the Crusades.

That's mighty white of you Nancy. Either do it or don't. Don't pretend that you might investigate to placate us. After putting the economy on the right path, investigating war crimes should be a top priority.

Look, she's not gonna say they're guilty before there's an investigation. But she said:
Let's get the truth out. And let's see the cases brought!
The more little tidbits we get from one or another leader, the better.
I'm gonna hope for Justice to be done. It is our moral duty because it is our legal obligation.

So far it has been a bit more than merely "unfortunate." Add disgraceful, impotent, submissive ... the list is endless.

Pelosi says:
This would require an investigation and a Justice Dept that upholds the law.
Does a "Truth Commission" have subpoena power and a Justice Dept that backs up the subpoenas? And its not just Torture/waterboarding, which seems all that concerns people. Its illegal spying on US Citizens, extraordinary rendition, the whole frikkin Iraq war, an American Citizen Jose Padilla, no bid contracts in Iraq....
I can see it now, Chairman of the Truth Commission; Lee Hamilton, a guy I've always felt
well, since Iran Contra, and more recently the 9/11 Commission, who feels that the Government has to be saved from too much damage.
I have little faith that the Democrats will do the right thing; fully investigate and prosecute those that broke the law.

Question is, what will Eric Holder do when confronted with clear evidence of war crimes? What will this administration do?
Can an administration that claims to be grounded by the rule of law and transparency really ignore hard evidence of war crimes?
Let's not forget that Nancy and Jay and Harry and others in Congress might be considered complicit in these crimes.

This is a lady who was perfectly capable of saying that impeachment was off the table. In this case, I hear somebody who knows it's not her branch of govt but she's also not going to stand in the way of DoJ. That's what I hear. But go ahead and goose her as much as you like. Cuz you and I are have our eye on the same ball - which is that investigations and prosecutions are a "must."

I agree... if we slack off making a stink, the folks in Washington will just forget us and go about fulfilling their OWN agenda... as we've been seeing these past twenty or thirty years.
Their inability or lack of desire to actually protect this country has gotten us into the mess we are in today. In fact, lack of accountability and scrutiny to protect our economy will most likely surpass these wars we've been in as a way of destroying this nation our ancestors tried so hard to build up... in their behalf, however, I really admire their ability to spew garbage on a daily basis and still continue to be reelected...
