Ken Starr: Coleman Faces "Uphill Battle"
One Republican is willing to openly say that Norm Coleman has a tough time ahead of him in his legal fight for the Minnesota Senate seat: Ken Starr, who described Coleman's situation as an "uphill battle," but isn't ruling out the idea entirely.
The former independent counsel was asked in a radio interview with WCCO-AM in the Twin Cities whether the U.S. Supreme Court would grant certiorari to Coleman's case. "I would tend to doubt it," said Starr. "I can understand why given the stakes, that every avenue of appeal would be exhausted. But we select our Senators through state elections, and so it is ultimately for the state, subject to fundamental rights of equality and so forth. So I would say it would be an uphill battle."
Starr did go on to add, though: "So I would just say, good lawyers can do a great job in making a case that might seem at first blush -- especially in light of Bush vs. Gore -- the kind of case that the Supreme Court might not want to be involved in, but you would be surprised. Some cases get up there that the smart money was wrong."

Remember, Kenny defended the anti-gay marriage position at the CA Supreme Court hearings on Prop 8. So he'll be back in the news the first week in June, when that ruling comes down.

The pop-ups/unders are starting to get annoying. Not cool, and something I don't run into at any other notable blog other than Salon on occassion when reading Glenn. It's really something that can drive away traffic.

Are you using Firefox or any of the popup blockers available for other browsers? I'm using FF 3.0.5 and don't get any popups/unders for TPM or its associated sites.

I got Firefox and didn't see any change in the ads -- lots of ugly teeth and fat abdomens -- and it also crashed frequently.
I just went back to SAFARI, which is much more reliable, even though the ad pics are hideous every day. Any suggestions?

Use Firefox with the Adblock and Flashblock add-ons. Sorry guys, but putting up animated ads makes sites unreadable and adblockers inevitable.

Nah, he's specifically setting the stage for Roberts, Scalia and Alito to do something courageous, decisive and groundbreaking by accepting cert and issuing an order returning Norm to office untl the case is decided, so as not to deprive the state's citizens of two senators...

Ken Starr? Don't we every get relief from suffering these fools? Starr must be frustrated that his name is not in the hat for Supreme Court appointment. Coleman must really be in deep trouble if this guy rears his head and spews more "legal wisdom".
