Liz Cheney Opposes Making Decisions Based On How You Want The Law To Work Out
Appearing on Fox News today, Liz Cheney worried that a judge who makes legal decisions based on how they want the law to work out "moves us away from the rule of law":
"And you know, you're not supposed to make decisions based on how you want the law to come out -- how you want the results to come out. If you're a judge or a Justice, obviously one would hope that you would be just strictly interpreting the law, and I think we've heard in a number of instances President Obama talk about, sort of, a results-oriented approach to the law, or you know, making these determinations based on your heart or your empathy. And I think that's dangerous. I think that moves us away from the rule of law."
Of course, this comes form someone who is mounting a huge public relations campaign for her father's policy that "enhanced interrogation" was legal and not torture. Interestingly, this Republican concern about results-oriented legal judgement was also lodged yesterday by John Yoo, one of the authors of the torture memos.

Damned straight. No place for that on the SC. Keep that stuff in the DoJ's OLC where it belongs.

Exactly. Otherwise, the next thing you know you'll have the SC justices voting to give the presidency to the son of the man who appointed them.

In that case: When does she disown Daddy Dearest?

She's not terribly bright.
A "results-oriented" approach? INterpreting the law in the context of the real world as opposed to in an abstract context is the same thing as a "results-oriented" approach? That was how Cheney was able to ignore the law for so long: the real world was a scary place where terrorists were about to jump out from under the bed, so to hell with the niceties of existing law. She doesn't see this?

As for "she doesn't see this?", I personally don't think she sees, period. Her clothes matching abilities are awful. You would think with money not being an issue, she could at least 'appear' classy.

She could afford to hire a stylist. She needs one so badly. Then she could go in for some elocution and speech lessons maybe that would take the whine out of her scratchy voice.

Why are you even bothering to report what SHE has to say? What expertise does she have? Besides that, who cares what she thinks? It was HER father that helped to get us in the worst mess in over a century.

Yeah really, when she's gained enough of her own accomplishments, maybe people will give a f--- what she has to say.

Well, if she really is considering a run for public office, then she's got to keep her face in front of the cameras, and Fox is happy to oblige.

Off topic, for which I apologize. I am extremely disappointed in President Obama for the sidestepping on Don't Ask Don't Tell. He is very capable at multi-tasking, and I just don't understand letting this ride while we lose some of our most talented linguists. And to not comment on Prop. 8 via Gibbs? At least say he hopes that we will keep fighting towards equality for all Americans regardless of race or gender.
May 27, 2009 12:56 PM | Reply | Permalink
I don't think he's sidestepping it, necessarily. I think he's letting momentum build--what with the statements by Mullins, the decision not to appeal that court case, the appearances by valuable members of military who had been dismissed.
But I feel a bit impatient, as well, what with his stating that he was a "fierce advocate" and all. Where's the ferocity, and where's the advocacy? What's going on is going beneath the political radar. Maybe that is fierce advocacy. Doesn't feel like it, though.

That is exactly how I feel. You said it quite well.
May 27, 2009 1:07 PM | Reply | Permalink
I understand letting momentum build. And on one hand, I agree. He doesn't have to drive everything from the top and, in fact, shouldn't.
But still there's the good military people losing their jobs because of this idiotic rule. And there's the good military people that maybe could be a little more effective if they could be themselves instead of being cut off and always on the defensive. I think an honest military, meaning one that doesn't force people to lie or lose their job, is a healthier military. And, to me, more effective.
I don't know how many we lose to this rule every year. But if honesty is installed as the military culture, isn't it better? Don't ask don't tell basically forces people to live as liars.
May 27, 2009 1:25 PM | Reply | Permalink
You are right. Isn't being in the military, in part, about honor? And how can it be honorable to ask them to lie?

“Judge Scalia is also widely regarded in his profession as a first-class intellect, a persuasive jurist, and a warm, caring person. ” September 17, 1986 Reagan on Scalia
If Scalia can judge with warmth and care can Sotomayor not judge with empathy? I mean, aren't they both injecting feelings into rulings at this point?
May 27, 2009 1:00 PM | Reply | Permalink
No. Scalia is, well, um, a white male. Sotomayor is a fiery (temperament, temperament, temperament--"judicial temperament" for Scalia) Latina (ethnicity is ok when you're Italian but not when you're Puerto Rican) bully (she wasn't nice to other white males).
Can't you see the difference?

It is exhausting - but I think it's for the best.
These people are incapable of empathy, of relating to anyone outside of their 35% bubble. They keep going on with their rantings... and losing more of the rational citizens in this country.
Think of what sunlight does to fungus. Let's shine a little more light on these dead-enders & show them for what they really are.

This line of "attack" has absolutely no chance of sticking unless specific simple examples are shown how Cheney, Yoo and others themselves have given a goal and then interpreted law in the most convenient way to achieve it.
I am sure there are plenty, but you have to actually show them. Otherwise it just looks like a three-year-old being kept at arm's length.

She has been on tv 12 times in 10 days and also on radio. We all know how important the US's ability to torture is for her. It's her main drive so now she must have some fear that the candidate Sotomayer will rule against it.

What an interesting observation. Maybe the impending choice by Obama was yet another motivator for Dickster and daughter to get out there and pre-empt the discussion.

The key to the Republican's success in "tweaking" public opinion is the near-stranglehold they still have over media speaking lists.
Progressives need to cultivate a stable of talking heads, and hire a small army to ensure that they're included on the talk shows.
How long do you think we'll be able to hang the "party of no ideas" on the Republicans if theirs are the only ones anyone ever hears?

Papa John's is closer to real pizza than Pizza Slut which is a grease soaked disk of salty dough with melted milk fat slathered all over it (that's just the basic cheese -- add your favorite carcinogenic preserved meat for more fat and salt). That said, no chain can produce authentic pizza.
