Liz Cheney Opposes Making Decisions Based On How You Want The Law To Work Out

Appearing on Fox News today, Liz Cheney worried that a judge who makes legal decisions based on how they want the law to work out "moves us away from the rule of law":

"And you know, you're not supposed to make decisions based on how you want the law to come out -- how you want the results to come out. If you're a judge or a Justice, obviously one would hope that you would be just strictly interpreting the law, and I think we've heard in a number of instances President Obama talk about, sort of, a results-oriented approach to the law, or you know, making these determinations based on your heart or your empathy. And I think that's dangerous. I think that moves us away from the rule of law."

Of course, this comes form someone who is mounting a huge public relations campaign for her father's policy that "enhanced interrogation" was legal and not torture. Interestingly, this Republican concern about results-oriented legal judgement was also lodged yesterday by John Yoo, one of the authors of the torture memos.

A "results-oriented" approach? INterpreting the law in the context of the real world as opposed to in an abstract context is the same thing as a "results-oriented" approach? That was how Cheney was able to ignore the law for so long: the real world was a scary place where terrorists were about to jump out from under the bed, so to hell with the niceties of existing law. She doesn't see this?

Off topic, for which I apologize. I am extremely disappointed in President Obama for the sidestepping on Don't Ask Don't Tell. He is very capable at multi-tasking, and I just don't understand letting this ride while we lose some of our most talented linguists. And to not comment on Prop. 8 via Gibbs? At least say he hopes that we will keep fighting towards equality for all Americans regardless of race or gender.

I don't think he's sidestepping it, necessarily. I think he's letting momentum build--what with the statements by Mullins, the decision not to appeal that court case, the appearances by valuable members of military who had been dismissed.

But I feel a bit impatient, as well, what with his stating that he was a "fierce advocate" and all. Where's the ferocity, and where's the advocacy? What's going on is going beneath the political radar. Maybe that is fierce advocacy. Doesn't feel like it, though.

I understand letting momentum build. And on one hand, I agree. He doesn't have to drive everything from the top and, in fact, shouldn't.

But still there's the good military people losing their jobs because of this idiotic rule. And there's the good military people that maybe could be a little more effective if they could be themselves instead of being cut off and always on the defensive. I think an honest military, meaning one that doesn't force people to lie or lose their job, is a healthier military. And, to me, more effective.

I don't know how many we lose to this rule every year. But if honesty is installed as the military culture, isn't it better? Don't ask don't tell basically forces people to live as liars.

No. Scalia is, well, um, a white male. Sotomayor is a fiery (temperament, temperament, temperament--"judicial temperament" for Scalia) Latina (ethnicity is ok when you're Italian but not when you're Puerto Rican) bully (she wasn't nice to other white males).

This line of "attack" has absolutely no chance of sticking unless specific simple examples are shown how Cheney, Yoo and others themselves have given a goal and then interpreted law in the most convenient way to achieve it.

I am sure there are plenty, but you have to actually show them. Otherwise it just looks like a three-year-old being kept at arm's length.

The key to the Republican's success in "tweaking" public opinion is the near-stranglehold they still have over media speaking lists.
