Romney: Sotomayor Nomination "Is Troubling"

Mitt Romney released this statement on the Sotomayor nomination, with strong words of criticism from a likely 2012 Republican candidate for president:

The nomination of Judge Sonia Sotomayor to the Supreme Court is troubling. Her public statements make it clear she has an expansive view of the role of the judiciary. Historically, the Court is where judges interpret the Constitution and apply the law. It should never be the place "where policy is made," as Judge Sotomayor has said. Like any nominee, she deserves a fair and thorough hearing. What the American public deserves is a judge who will put the law above her own personal political philosophy.

Republicans open their mouths, and lie. Let's see if the media actually lets the Mittster get away with this misstatement, or if it becomes the rallying cry of Republicans.

Sotomayor never said that the Supreme Court is the place where policy is made. She was referring to the Appeals Court, not the Supreme Court, and her comment isn't particularly controversial.

But it's probably good to have Phoniness Epitomized objecting to her.

The Republican's attack will begin, "some say..." which only define their position because they are afraid to associate the slime with themselves. It was/is a favorite of Rove and Cheney. The whisper campaign has already been flattened where it belongs. As though it would be difficult to get someone in the Federalist Society to try to minimize her. I get a kick out of those that call her dumb. Of course an hispanic woman at Princeton or Yale Law wouldn't have run into discrimination and have to prove herselfmore than others. "Some say" she isn't a brilliant decision writer. "Soome say" Clarence Thomas hasn't knocked anybody's socks off with his written opinions! These people crying about activist judges and rule of law must have been sleepwalking for the last 8 years and 5 months with what happened in the Bush administration with Roberts and Alito. Especially Roberts.
