Dem Web Video Depicts Republican Candidate As Evil Rampaging Robot

Check out this incredible Web video that the Democratic Senatorial Campaign Committee came out with yesterday evening, attacking Rep. Mark Kirk (R-IL) in the Illinois Senate race. They don't just say Kirk morphs between his moderate image versus his conservative positions -- he's now a full-fledged Decepticon:

"Now that he's running for Senate, Mark Kirk has become a Transformer," the announcer says.

Unfortunately, this is only a Web video. The DSCC is not putting this amazing piece of advertising on TV.

I don't find this ad to be very effective. I find it very silly. If it is a web ad, the people it is targeting probably don't even own a computer or know how to operate one. I am feeling very mean today

Silly ad, and I agree with the poster who posted the youtube linked ad as that was a good one. However I think this ad is hilarious especially with Mark Kirk's head on top of the robot. Maybe the military should look into getting one of those it looks rather powerful.

There is a simple likely reason for Dems not running this ad on TV. It is a common belief--even among those who should know better--that copyright and trademark issues that apply to items appearing in broadcast do not apply to items that are limited to the web (or, for that matter, things that are free are not going to have the same problems as things that are not). The folly of this thinking is rather obvious--just witness the Republican sniveling response to the Jackson Browne suit.

There is an obvious violation here because they used the term "transformer" to apply to a dual man/robot being. Although the word is a common one, the use is not--and, in fact, it is specific enough to the toys, cartoons and movies that it can function as a trademark. As long as the Dems are just playing around with the web ad, no one is likely to complain. And even if the mark owners are to complain, it's much easier to withdraw the web ad without much fanfare, while withdrawal of a broadcast ad would be much more public.

So, my guess is that it is a calculated move. But there will be similar broadcast spots without involving the Transformer image.
