Reid Refuses To Honor Republican Holds On Census Nominee
Senate Majority Leader Harry Reid's office just told TPMDC that the senator will file for cloture on the nomination of Robert Groves, whom President Obama tapped to be director of the Census Bureau on April 2.
Groves, the 60-year-old director of the University of Michigan's Survey Research Center, sailed through confirmation hearings in mid-May, but shortly thereafter, anonymous Republican senators held up his nomination, preventing a confirmation vote and leaving the bureau without a director. Earlier today Roll Call (sub. req.) reported that those holds were placed by Sens. Richard Shelby (R-AL) and David Vitter (R-LA).
The census, performed every ten years by Constitutional mandate, is not merely an exercise in demography: The populations of states and counties are used to determine Congressional reapportionment and redistricting, which will happen again before the 2012 election cycle. Moreover, state population totals affect the allocation of hundreds of millions of dollars in federal funding to states for highway construction and renovation, Medicaid, and education, among other expenditures.
Publicly, Republicans attribute their opposition to Groves to his statistical expertise and his history at the Census Bureau. While an associate director at the bureau in the early 1990s, Groves advocated the use of his specialty, statistical sampling, which can be used to compensate for undercounted demographics, such as illegal immigrants and the poor. (Republicans have effectively prevented census sampling for decades.) But in his confirmation hearings earlier this year, Groves promised not to use sampling. And Commerce Secretary Gary Locke--whose department oversees the census--noted that the Supreme Court had rejected sampling as a method to determine Congressional district reapportionment (though it left unclear whether the method could be used to determine redistricting or federal funding for states).
Yet, despite Groves' pledge, Shelby and Vitter have maintained the hold for nearly two months. At least one prominent Republican senator, Susan Collins of Maine, has spoken out in favor of Obama's nominee. "I do not know who has placed a hold on Mr. Groves' nomination, nor do I understand the rationale for holding him up," she told the Associated Press in June. "I am very eager to get this qualified candidate on the job." Collins is the ranking Republican on the Senate Homeland Security Committee, which considered Groves' nomination.

cloture is a vote to limit debate, it takes 60 votes to pass. after debate the nominee is given a straight up or down vote.

Cloture is a special garment warn only by the Senate Majority Leader. (The uninformed often called it a cape.) It is kept by the Sergeant-at-Arms and who is authorized to give it to the Majority Leader for a limited period of time when, after a filing at least 60 senators vote to allow him to have it. When wearing the garment, the Majority Leader can require that all Senators sit "straight up" and vote on the issue named in the filing. If he doesn't like their decision, he can send a senator of his choosing "straight down" to the dudgeon beneath the 4th sub-basement in the senate chambers.

Shelby's a kind man, BTW. Fueled the birth certificate disinformation campaign back when. I saw him on video, he tried to deny it and got slapped down. Tougher to do hit and run in internet age.

Reid's been trying to corral the cats (aka Dem Senators) on cloture lately.
He may be starting off simple. Get them used to the concept off voting with the team. This is a simple vote - director of the census, held up by Diaper Dave Vitter and Richard "that black man's not my president" Shelby. Heck, even some Republicans might go along with Harry. (Nah, just dreaming there.)
Once the Democratic senators get used to this, he'll introduce them to the concept of "vote for cloture, vote against nominee/bill" which gives them cover back at home. And train them to use the line "Sure I voted for cloture. That's a vote to stop talking and start working." Maybe even go on from here to say that all the Republican senators want to do is talk, no action.
It's a slow process, but I'm hoping that eventually every Democratic senator will learn and understand.

Good points all, but don't be expecting block voting on a lot of issues any time soon with the Dems. With the Blue Dogs/Mod Dem Wrk. Grp. acting semi-independently, complications always are going to crop up when it comes to reining in votes. (ignoring the New Dems--what have they done lately anyway?)

"Traditional" privileges and courtesies like the anonymous hold were crafted solely to boost the horse-trading clout of individual congresscritters. Using them to permanently veto pending legislation or appointments violates even the Senate's notoriously low standard of behavior.
