Sen. Lindsey Graham, not known for holding back criticism of the White House, said today that he has "very strong feelings" about Guantanamo Bay detainees but will hold them in until President Obama returns from his trip to Asia.

Graham (R-SC) just issued this statement responding to the administration's announcement to transfer Khalid Sheikh Mohammed and four other Gitmo detainees to be tried in New York.

"The decision on the proper venue to try Guantanamo detainees, particularly the 9/11 conspirators, is one of the most important decisions we will ever make in the War on Terror. I have had and continue to have very strong feelings on this subject. Those feelings are well-known as evidenced by our debate on the floor of the Senate last week. "I have been asked by the White House to withhold comment about today's Guantanamo decision until I can meet face-to-face with the President after he returns from Asia. As our Commander in Chief, I will honor his request. I look forward to discussing this issue further."


Meanwhile, Obama's 2008 rival and Graham close friend Sen. John McCain said he was disappointed by the decision.

McCain's statement:

"I am extremely disappointed with the Obama Administration's decision to try in U.S. civilian courts the Al-Qaeda terrorists who planned, supported, and conducted the September 11th attacks. These terrorists are not common criminals. They are war criminals, who committed acts of war against our citizens and those of dozens of other nations.

"Terrorists who have declared war against our country should be treated as war criminals and tried for their crimes through military tribunals. In a letter sent to Congress just last week, hundreds of families of victims of the September 11th attacks urged the Administration to try these terrorists in military tribunals, and I fully respect and agree with their position. I have worked tirelessly with my colleagues in Congress and with the Obama Administration to make our military tribunals system better able to dispense justice efficiently and fairly while protecting secure information."

Sen. Joe Lieberman (I-CT) was similarly harsh.

TPMDC was on a call this afternoon with senior officials from the Justice and Defense departments. They didn't commit to a date for closing Gitmo, but repeatedly said they were "making good progress" toward its shut down.

Joe Lieberman is against anything the Obama Administration is for. He's still pissed that he's not Secretary of State in the McCain administration and will be out of office in three years without any chance at an administration job or Ambassadorship to Israel until 2016 at least.

So the "War on drugs" means that drug dealers should be charged through military tribunals as well?

When it's not State-sponsored and targets civilians, it's a law enforcement issue.

Sen Graham once again emerges as one of the more honorable members of the GOP - not that that's saying much... it's a pretty low bar.

Graham is considered the 15th most conservative Senator.

But that's not good enough: He is brave and principled. And for that, off with his head!

(I am beginning to think Graham was born to an Al Qaeda family in Indonesia, with this Hitlerian Communist respect for process he as been showing -- just like Pol Pot!)

Oh, he was always against the gitmo crap. He wanted to use the UCMJ, which would be fine as well. He may whine a little, but the fact that he is not saying anything right now, speaks volumes about him actually. No wonder the right wingers are going nuts over him.

Not that the opinion of a regular, ole' taxpaying American counts for anything, but I for one am happy that the effort to bring these people to justice will be open to me and my fellow citizens and will not be solely the secret purview of a military tribunal. Not that I think the conclusion will be all that different regardless of venue, but it seems to me that this was a crime against the American people--not just the military--and we don't deserve to be shut out of the process just to fulfill some political need to look 'strong on terror.'

I wish the Dems hadn't so thoroughly accepted the narrative that the "pre-911 law enforcement paradigm" for terrorism was wrong. I wish Obama could successfully make the argument that, in fact, the law enforcement paradigm is exactly the right one for combatting terrorism. Unfortunately, it's become such a sacred cow now that he probably can't make the argument without huge political blowback.

Our law enforcement agencies are arguably the most competent and successful in the world. Yes, we could beef up and streamline international cooperation, which we should do anyway to address things like the Russian mafia and international drug cartels. Our military is competent (compared to other militaries, certainly) but no military is designed to bring individuals and groups to justice or to combat organized crime and corruption. It is, as my father likes to say, like a bear trying to use its formidable claws to try to defend itself from a swarm of bees.
