
Sen. Ben Nelson (D-NE) will join with Republicans to block cloture on a nominee for the National Labor Relations Board that President Obama has sent to the Senate. In a statement yesterday, Nelson lashed out at the nominee, Craig Becker, saying he'll "pursue an aggressive personal agenda" on the board.
Becker's nomination has been controversial among conservatives and Republicans since it was announced. The right views Becker's past as an SEIU lawyer as a harbinger that he'll take pro-labor stances that Republicans and business leaders have long viewed with trepidation.
In his statement yesterday, Nelson lent his voice to those concerns, citing Becker's past statements that Republicans have used in their campaign against the nominee.
Nelson's full statement:
February 8, 2010 - Today, Nebraska's Senator Ben Nelson announced that he will oppose a cloture motion to proceed to a vote and will vote no on the nomination of Craig Becker to be a board member of the National Labor Relations Board. The five-member board serves as a quasi-judicial body in deciding cases under the National Labor Relations Act."Mr. Becker's previous statements strongly indicate that he would take an aggressive personal agenda to the NLRB, and that he would pursue a personal agenda there, rather than that of the Administration," said Senator Nelson. "This is of great concern, considering that the Board's main responsibility is to resolve labor disputes with an even and impartial hand. In addition, the nominee's statements fly in the face of Nebraska's Right to Work laws, which have been credited in part with our excellent business climate that has attracted employers and many good jobs to Nebraska. Considering these matters, I will oppose the upcoming cloture motion and the nomination."
Among some of the previous statements by the nominee that raise concerns for the senator:
• In a 1993 Minnesota Law Review article Becker wrote: "On account of the asymmetry between representation elections in the workplace and the polity, Part IV [of the article] concludes that employers should have no legally sanctioned role in union elections."
• In the same article Becker asserted that employees should be compelled to join labor unions: "...it could be argued that industrial democracy should be made more like political democracy by altering the nature of the choice presented to workers in union elections. Such a reform would mandate employee representation, and the question posed on the ballot would simply be which representative."
• Becker has expressed his intent to limit the ability of employees to reject union representation: "At first blush it might seem fair to give workers the choice to remain unrepresented. But, in providing workers this 'non-representation' option, U.S. labor law grants employers a powerful incentive." [New Labor Forum Fall/Winter 1998.]

That's been my thought since before the Senate was considering health care reform. The penalty for opposing your party on procedural votes and preventing majority rule ought to be you lose your chairmanship. If it means the Dems go down from 59 votes to 58, 57 or even 56, so what?

The other overlooked factor was that back then, there was a moral core that ran through both parties. That's how the CRA passed in the first place. That core has long since been corrupted by the influence of corporate lobbyists. Harry Reid couldn't even enunciate a party line, let alone enforce one.

FYI, most of those Democratic Senators who made the lives of Johnson and majority leader Mansfield a living hell died and/or retired as Democrats and with great respect. Russell even got a Senate building named after him. Sam Irving, a constitutional racist, was treated like a hero after Watergate.
The contention that Democrats only bucked Harry Reid is pure fiction. Getting Democrats to stay in line has always been like herding cats.

Look at the statements - the most recent is from 1993, for crying out loud. Plus, the actual comments are: 1. Companies shouldn't be allowed to screw around with union elections the way they do now 2. It could be argued (which means it isn't going to happen in lawspeak) people would be better with mandatory collective bargaining 3. Companies wouldn't meddle with organizing if the choice was among unions, rather than between union and non unions.
Does anyone seriously disagree with these statements or think they are "dangerous" to anyone or anything other than Wal-Mart's corporate profits? And who would Nelson support - someone who views unions as presumptively improper as an interference with "worker freedom" (ie a Republican)?

And Wal-Mart's first response was to shut the stores down that voted to unionize and move something like 20 kilometers down the road. If they had no ability to interfere/retaliate like that, stores in the US would be much more likely to organize.

When I heard about Sen. Nelson's stance this morning it made me wonder if there's an underlying ploy here. This is pure speculation, but I have been wondering if the Obama administration and Congressional Democrats would like to find a way to distance themselves from the Cornhusker Kickback in the Senate HCR bill and as such if they have been threatening to pull that provision out of a final bill.
Of course, this only works if they are planning on using reconciliation, at which point Nelson's vote is no longer needed. This may be Nelson's way of signaling what will happen if he doesn't get his way. Honestly, I say forget him. I think the Democrats need to start working with those who consistently stand behind them and Nelson is indicating that he's not that kind of Democrat.

You are correct, Otter. I believe it is called "projection." Nelson is projecting what he actually does on Craig Becker. It was Nelson who got extra monies for Nebraskans on Medicare as part of the Health Care bill.
Nelson has it wrong, of course. The NLRB was created to protect workers and their interests. So, the reality should be appointments that actually promote that and not corporate interests at the expense of workers.

right -- if the Labor Relations Board rules in favor of workers in a labor dispute it's a ruling based on a "personal" agenda.. only if it rules in favor of corporate interests is it being "impartial"... ah yes.. once more the American klepto-oligarchy and its right-wing supporters and enablers in Congress working together to sabotage the interests of ordinary Americans -- folks who, I might add, are supposed to represent INDIVIDUALS, voters, not corporate interests.. but hey, this is America after all, the "greatest" country in the world, right??.....;-)
