
D.C. Superior Court officials have warned that Sen. Jim DeMint's hold on President Obama's nominee for that bench could harm the court's ability to hear cases in the nation's capitol.
DeMint (R-SC) has said he is holding up Marisa Demeo's nomination to serve on the D.C. Superior Court because she has a "history of very leftist activism," the Legal Times (sub. req.) reported today.
"There are just a number of things that don't look like a fair and balanced approach that you'd like in a judge," DeMint told the Legal Times.
DeMint's criticism seems to be centered on Demeo's work for the Mexican American Legal Defense and Education Fund (MALDEF).
The Legal Times story says Demeo has been pending "longer than the wait for any other [Obama] judicial nominee."
Demeo, who is openly gay, was nominated nearly one year ago and was approved by Sen. Joe Lieberman's Homeland Security and Government Affairs Committee in May 2009.
She has been a Magistrate Judge in the Criminal Division of the D.C. Superior Court since 2007.
That's led to a delay for confirmation of another D.C. Superior Court nominee, Stuart Nash. One catch - Nash was nominated by former President George W. Bush before he left office.
The Legal Times reported that D.C. Superior Court Chief Judge Lee Satterfield wrote a letter to Senate leadership in October saying that if Demeo and Nash were delayed further, the number of active judges would drop to 57 and "such a scenario would certainly test our ability to administer justice for the people of the District of Columbia in a timely fashion."
Obama nominated Demeo last March, saying she and another colleague have "dedicated their careers to serving the public good and they will be esteemed and eminent additions to the DC Superior Court." (That colleague, Florence Pan, was confirmed by the Senate in May.)
DeMint's office has not responded to our calls or emails.
Late Update: Senate Majority Leader Harry Reid spokeswoman Regan Lachapelle sent over a statement:
Republicans continue to hold her nomination. We have asked to pair her nomination with the Republican nominee (Stuart Nash) for the DC superior court and they still object. We have not been advised of their specific objections.

As much as I support this idea in principle, I don't think we can count on the news media reporting anything useful about the issue. It would just devolve into, "Obama's nominee for a court judgeship is being held up by Senator Jim DeMint. Senator DeMint has stated that he is concerned about the candidate's liberal views. The candidate's supporters disagree. And now let's go to Paris, Texas where reports are coming in that a pretty white girl has gone missing."

It's more important to DeMint that there be no judges with an ideology (or sexuality for that matter) that differs from his, even if it means putting the country at risk. DeMint is not a patriot and, with the help of the Supreme Court, is sowing the seeds of fascism.

I know the filibuster is the focus of people, but this damn courtesy hold stuff is ridiculous. We don't have a TSA head - because of a hold related to unrelated issues that finally wore the nominee out. Vitter has held up Corp of Engineers on a hold on unrelated issues. We don't have a head of OLC because of dingleberry holds on Dawn Johnsen mainly for being a critic of Bush (oh no!)
It is stupid and should be done away with, especially since the same handful of asshats keep abusing the system. Reid's unwilling to call people on it - because he won't call anyone on anything - but this has just got to go.

It is the same as ending a filibuster. They need to call for cloture, then wait for a day or two until they can take the vote. That is one reason the Republicans are doing this. The Senate is only allowed to look at so many things at once, and if the time is taken up getting the nominees through, real legislation does not get worked on.

No it's not. A hold is by agreement not parlimentary rule. The Dems can simply ignore the hold and proceed. That would precipitate the Reps ignoring all Dem holds in the future though. So we fuck ourselves and thank them in the process so we can make sure they agree to be fucked when it's their turn.

Oh well, the press would pick up that just another activist leftist judge was nominated by that radical Obama, and is held up by a patriotic Senator who wants the Constitution upheld, and not judges legislating from the bench. That can be paired with a statement from the same Senator praising the Supreme Court decision on campaign financing.

I'm one of those citizens, so I think I'll pass on your proposal. DeMint is an excrescence, a pimple on the body politic, and a disgrace to SC and the country as a whole. He couldn't ratiocinate his way out of a small wet paper bag, and he has grand ambitions to rat-fuck the entire country at some future date.
Harry Reid should step down now to "handle his campaign," and let them elect Schumer to ram this shit down the gaping collective maw of the Senate minority all whilst having his foot up their collective gaping asshole.

I don't think any court hears cases in the Capitol... the capital perhaps, but not since 1935 has the Supreme Court convened in the Capitol building.
What work at MALDEF? Care to go into specifics TPM?
Why does the judge's sexual orientation factor into this story? I thought we were beyond that this day in age.
While a hold is different than a filibuster, the end is equally obstructive. All judges deserve a fair up and down vote in the Senate. That said, let's not forget that in 2004, it was the Democrats who BEGAN the unprecedented act of filibustering judicial nominees, including Miguel Estrada, Priscilla Owen, Charles W. Pickering, Carolyn Kuhl, David W. McKeague, Henry Saad, Richard Allen Griffin, William H. Pryor, William Gerry Myers III and Janice Rogers Brown. It was then that the "nuclear or constitutional option" was first discussed to prevent the use of filibusters for judicial nominees.
