The Indiana Democrats are on the verge of not holding a primary to choose a nominee for the U.S. Senate, something retiring Sen. Evan Bayh seems to have no problem with and which has a longshot candidate crying foul.

Now the Republicans are getting in on the action, with National Republican Senatorial Committee Sen. John Cornyn challenging Bayh to change the process since it seems like an unfair.

This could end up being a key point, especially given how the Republican party faced serious trouble in New York's 23rd Congressional district after selecting a candidate from behind a closed door.

Bayh announced he won't seek reelection yesterday, leaving Democrats with little wiggle room to get a candidate on the primary ballot since 4,500 signatures (500 from each Congressional district) are due today.

Cornyn (R-TX) said the five Republican candidates have spent the time to gather their signatures from across the Hoosier State, something he said "makes clear to voters exactly who is running for what office, giving voters, not party bosses, the opportunity to choose their respective candidates."

In a statement issued by the NRSC, Cornyn pointedly questions the timing of the Bayh announcement and challenges the senator to step in:

Numerous reports over the last 24 hours indicate that Democrats intend to try and bypass the public petition process, making Indiana's requirement that Senate candidates gather 4,500 signatures meaningless. They seem to assume that Indiana law addresses the scenario of Senator Bayh's leaving his party with no filed candidate. Moreover, the question should be asked what exactly the Republican candidates have been working so hard to accomplish in recent weeks?

While I believe both parties should have a nominee to offer voters in November, both political parties, and particularly Senator Bayh, should also be committed to a full, fair and transparent nomination process. While I'm not questioning Senator Bayh's motives behind the timing of his announcement, the reality and ramifications of this timing cannot, and should not be ignored.

Assuming there is no qualified candidate that files the appropriate documentation before the deadline, Senator Bayh should call on the State Democratic Party to ask an Indiana court to extend the candidate filing deadline - both for this Senate candidacy and for any House candidacy that is left open by a Democrat House member who runs for the Senate nomination. Doing so would remove any appearance of unfair gamesmanship by the Democrats while affirming their belief that voters, and not party bosses, should be the final arbiters of elections.

In Indiana, running for Senate is, as it should be, an open and transparent process. It is my hope that Senator Bayh and his Party's leadership will re-commit themselves to that important principle by immediately rejecting the notion that their nominee will be chosen behind closed doors and allow Hoosiers the opportunity to choose their respective candidates in this important Senate race.

Nothing can be done about it. The law is the law. I am sure that the possible Dem candidates for the Senate would prefer a primary but it is just too late.

I think the Democrats should at least consider holding something like an internally administered primary, with all persons given a chance to get in the running who would have been running in the normal primary had Bayh made his exit in a timely manner. This would help ensure that the candidate chosen has the backing of the actual party electorate. Whoever wins this pseudo-primary gets the party backing.

But a primary with the only choices being Bayh (not running) and d'Ippolito (who?) isn't really a primary, is it?

I think he should as well. Take away this obvious talking point. Who cares of Tamyra gets on the ballot as long as it wasn't by herself, as she has zero shot of even getting within 50 points of the eventual Dem flag bearer. Any money she'd raise would have been from Operation chaos folks ie Republicans.

Unfair gamesmanship? Really? Unfair gamesmanship? This, from the party that demands a 60-vote supermajority in the Senate even for routine administrative actions? Unfair gamesmanship? This, from the party that makes up lies about Kenyan birth certificates and death panels? Unfair gamesmanship?

First: With all the unfair gamesmanship inflicted upon us by the Republicans recently, I would counsel them not to throw stones from within their glass houses.

Second: The law is the law and the rules are the rules. The Republicans have been fully aware of this long-standing deadline. If they don't have any good candidates, tough.

Third: The courts of Indiana have no grounds upon which to order a deadline extension to an internal political party process, and Cornyn knows it. So, this whole political posturing is itself just Cornyn's feeble attempt at his own unfair gamesmanship.

Finally: Ha ha ha ha ha ha ha ha!!! We get to pick a nice strong moderate candidate with wide voter appeal and you're stuck with Stutzman, Bates and maybe Coats. Deal with it!

Does anyone remember that Bill Owens (NY-23) was chosen by the party instead of through a primary? NO.

Voters don't care about shit like this. Voters didn't care that Dede was selected by the party. The teabaggers brought her down because she was too liberal.

The rules have been set. Changing them because we don't like the potential outcome resembles Hillary's efforts to change the rules for Florida and Michigan because she was losing.

You're missing his point. The GOP will make noise about the back room business, but they'll also look for a chance to upgrade from the sacrificial lamb-grade candidates on their primary ballot. More Bush v. Gore-style electoral Calvinball from the GOP.

I also call upon Senator Bayh to fart out a cloud of mystastic rainbow faeries who will eliminate the state of Indiana's budget hole with magic deficit pixie dust. The people of Indiana deserve nothing less and Sen. Bayh's failure to do this, given that it clearly within his power--and the faeries' power--is very, very troubling and significant.

Cornyn should mind his own gd business..........what is he so threatened about.....Dan Coats has no business in the senate again............he was the chief lobbyist for Bank of America, Dubai, and a host of other places that I don't think will play too well in Indiana...especially with the farm and home foreclosures and high unemployment there.

I loathe Cornyn....he is the face of all that is wrong with the Congress and he is corrupt.
