Cal Cunningham, a candidate for the Democratic nomination for Senate in North Carolina, is now seeking to make reform of the filibuster an issue in his campaign.

In an e-mail sent out to his campaign's supporter list, Cunningham lambastes incumbent Republican Sen. Richard Burr for holding up health care reform. But he says the real problem comes from the Senate's broken processes:

Dear Friend,

Who did America's insurance companies pick to headline their annual industry breakfast week after next? The North Carolina politician who's received nearly $1.7 million from health and insurance interests to carry their water in the U.S. Senate: Richard Burr.

It's bad enough that our senator would rather protect big insurance companies' (the "Big 'I'") windfall profits than fight for North Carolina's families, so many of whom struggle with skyrocketing health care costs and lack of coverage.

But the real travesty is that an outdated Senate procedural rule, the filibuster, empowers a few dozen obstructionists like Richard Burr to effectively guarantee the special interest groups get their way.

It's time to end the wheeling and dealing that smothers good ideas and stifles real progress in Washington.

It's time to end the filibuster in its current form. If you agree, sign my online petition to tell our elected and party leaders it's time to change the filibuster.

A statement released yesterday by the insurance industry lobby proclaimed "The Big 'I' is pleased that Sen. Burr will be kicking off our annual agent pilgrimage to Capitol Hill... [and] looking forward to hearing his insights on health care reform..."

Burr's so-called "insights" on health care reform will go something like this: delay, obstruct, and preserve the status quo. His tool of choice? The filibuster.

The filibuster has evolved to require a 60-vote supermajority to pass virtually any important legislation in the Senate. Richard Burr, along with other obstructionists in the Senate, has even begun using the filibuster to block votes on legislation they previously supported, just to deprive the president of legislative victories.

Enough is enough. We cannot let a small minority in the Senate continue holding up health care reform -- and countless other initiatives supported by the American people and a majority of Senators.

Sign my petition to end the filibuster's stranglehold on the U.S. Senate.

We'll never get the strong health care changes we need if a handful of insurance industry-backed obstructionists like Richard Burr can prevent a bill from even being voted upon, much less sent to the president's desk and signed into law.

Byrd was singing praises to filibuster back in 2000, but it was when republicans were using it. Since his jerk is a lefty, there's no point in telling him about federalist papers or anything like that. he's an opportunist, enough said.

Well, my incoherent immigrant friend whose connection to the English language is roughly at a 5th degree of approximation, there is no connection between the filibuster, a clearly unconstitutional artifice, and the Federalist papers. Since when do they teach the Federalist papers in FRY, anyway?

a) It's been a good twenty five years since I last read all of the Federalist Papers, but notwithstanding all the pretty talk about protecting the rights of the minority, I am certain that neither Madison, Jay or even Hamilton said one goddamned thing about what a great thing it would be if the Senate in the still-hypothetical Senate adopted a rule by which the minority could demand that every bill pass by a supermajority.

b) The Republicans controlled the Senate in 2000. That would be Bill Clinton's last year.

c) In the two years of the 106th Congress, the Congress in which the Republicans impeached Clinton for the horrendous crime of lying about accepting a hummer, the Democrats used the filibuster in defense of their president's agenda less than half as many times in the whole session than the Republicans have in this Congress already. And that failed to beat the previous record (set, of course, by the Republicans in 1992-94).

The Republicans are on a pace to use a rule that used be invoked less than twenty times a session more than two hundred times.

Who cares about the Federalist papers? Not me. They don't feed, clothe or care for my family and friends.

Lalo, you are sadly being deceived. You are nothing but a wage slave. The master may let you work in the house, but do not forget for a minute that you are still a slave.

This is another stupid wedge issue, designed to generate dissent amongst the masses. We're screaming at each other while the rich are laughing their asses off. Focus on the real issue.

Not surprisingly, the Federalist did not mention the filibuster or unlimited debate. The filibuster is not in the constitution - it's purely a creation of senate rules, which obviously had not been adopted prior to the creation of the Senate.

The original rules of the Senate allowed for a senator to "call the previous question" -- immediately closing debate on a matter -- but ironically, when the rules were revised in the early 19th century, the motion was dropped because it was never used.

An absolute majority of the Senate (51 Senators) should end a filibuster. That signals that a majority of that body wants an open vote on an issue before the Senate. Same procedure for these ridiculous "holds" individual Senators place on presidential appointees. I understand the fears of a "tyranny of the majority" from either party, but the current parliamentary system in the Senate is clearly broken.

Good to hear, but forget the filibuster has to go in its "current form".

It is a piece of undemocratic trash, and should be jettisoned.

I don't give a frikking goddam who is in the majority, the Senate is ALREADY inherently non-representational.

Skewing it any more than that with bulls**t procedural rules makes me sick.

And the only reason the majority wants to keep it in some form is so invididual Senators can potentially hold up the majority.

Screw them.

Of the people, by the people, for the people, NOT for individual Senators and their self blown importance.

Stop the crap, toss it overboard and get some goddam legislation passed.

To get back to the substance of this post, this guy shows some real courage, and he might appeal to those tea partiers who are angry (and I join them in that) but not crazy or racist. I've been saying for months that Democrats should be looking for support among those groups of tea partiers.

Burr is standing in the way of the American people. We had an election in 2008 and the voice of the people was clearly and plainly spoken. Senator Burr is abusing the privileges of the minority to spit in the eye of the American people.

Yawn. Cunningham's primary opponent Elaine Marshall has been running a petition in support of the public option for months, and as noted upthread has already come out in favor of filibuster reform.

When Cunningham comes out swinging for the public option, I'll start listening. Until then running on process issues is not going to give him much traction with me or with many other North Carolina voters.
