President Obama Signs Historic Health Care Bill -- Fixes Come Next

With much fanfare, dozens of pens and members of Congress beaming at his side, President Obama signed a sweeping health care reform bill this morning.

"Today after almost a century of trying; today after a year of debate; today after all the votes have been tallied health, insurance reform becomes" the law of the land in America, Obama said in the White House East Room. He called the fact that health reform passed "a testament" to the American people and the lawmakers who "took their lumps" this year, to which Rep. Gary Ackerman shouted "Yes, we did" to laughter.

Obama touted the parts of the bill that go into effect this year. The legislation offers tax credits to 4 million small businesses to help them afford health care for their employees, stops insurance companies from denying coverage because of pre-existing conditions, eradicates lifetime caps on coverage and allows young adults to stay on their parents insurance longer.

"That happens this year," the president said, noting that it will take four years to implement the bulk of the legislation because "we need to get this right."

"I'm signing this bill on behalf of my mom," who fought insurance companies even as she was dying from cancer more than a decade ago, Obama said. The president said he was also signing the bill for other leaders who tried to make health reform happen, from Teddy Roosevelt to Franklin Roosevelt, Harry Truman, Lyndon Johnson, Bill and Hillary Clinton, Rep. John Dingell to the late Sen. Ted Kennedy. Caroline Kennedy sat in the front row smiling.

"We are not a nation that scales back its aspirations," Obama said. "We are not a nation that does what's easy. That's not who we are. That's not how we got here."

To senior citizens, Obama said "these reforms will not cut your guaranteed benefits." The president also noted that he is confident the Senate will pass the reconciliation bill soon, a line that received huge cheers from the House Democrats in the room who were nervous about passing the Senate bill with all of its problems. The reconciliation measure corrects several major items and is expected to pass the Senate and be signed by Obama in the coming week. Sen. Bernie Sanders (I-VT) turned to Rep. Dave Obey (D-WI) and they both burst out laughing.

After months of wrangling, the House approved on March 21 the Senate's health care bill by a razor thin margin of 219-212. The fate of health care reform had hung in the balance over the Fall and Winter, as Democrats have watched their popularity fade and their majority shrink after town hall meetings erupted in anger over the legislation. And then, after Republican Scott Brown (R-MA) won a special election to take the Kennedy's old Senate seat in January, Democrats were deprived of a 60th vote in the Senate and nearly lost the nerve to pass health reform altogether.

But what a difference two months can make. House Democrats made a big show of piling into buses to head down Pennsylvania Avenue for the ceremony. The mood at the signing ceremony was nearly ecstatic and some members even wiped away happy tears. White House Chief of Staff Rahm Emanuel shook hands with members in a back room. Sen. Patrick Leahy (D-VT) was snapping pictures of his colleagues, something he's known for doing in D.C. on historic occasions.

Democratic Senators mingled in the Grand Foyer of the White House as their House counterparts arrived for the ceremony. A U.S. Marine played light music on piano.

Rep. Dennis Kucinch (D-OH) had a seat in the front row. Rep. Bart Stupak (D-MI) smiled and shook colleagues' hands.

A White House aide told TPMDC there were more reporters crowding into the East Room to witness the ceremony than have been here for presidential press conferences. Health care special adviser Nancy-Ann DeParle brought her son, and was specially recognized by Obama. Staffers from the administration's health care team sat in the back rows of the East Room, some looking as if they were holding back tears.

"Mister President, I think we've got a happy room here," Vice President Joe Biden told Obama. There were shouts of "Here here" from members, who were snapping their own pics from cameras and blackberries.

Obama stayed shaking hands and posing for photos with the Democrats much longer than he has for other large signing ceremonies. Usually the president leaves the room and leaves members to mingle for awhile. White House Press Secretary Robert Gibbs wrote on Twitter that Obama wore a "blue Tedstrong bracelet," similar to yellow Livestrong bracelets worn by Lance Armstrong. It was a gift from Kennedy's widow Vicki.

House Speaker Nancy Pelosi signed the measure yesterday in a short ceremony on Capitol Hill, several times referencing the "corrections" to the bill that will be made this week in the Senate. Democrats say they expect the Senate to wrap up its business and send that reconciliation measure to the president for his signature to finally complete their work on health care for the year.

"As you can see this is a very big bill. All that needs to be done are the corrections in the Senate," Pelosi told reporters, adding she is not worried about any antics from Senate Republicans that might change the reconciliation package.

Well, I have taken a lot of heat for my support of this President and I was/am gladly willing to do so because I believe in him and know he is a man of integrity and would come through. We let the media and even the crazy misleading stories here on the internet sway our opinion of him. That attempt by the media and the thugs was no accident. He is way too brilliant of a guy to get elected on hope and change and then turn his backs on us. It made no sense then and it makes no sense now. The forces tried to stop him but they failed. He did not!

My friends at tpm, this is what leadership looks like and this is what change looks like.

In order to wipe these people off the face of politics for the next 20 years we need to support this president who faces monumental challenges everyday.

That's how I see it.

not even close and am budgeted to the edge right now, there is no place to find an additional 4k a year to keep the IRS from hounding me, nor the $1000 or so they will add on to my taxes. So basically am worse off than before...I notice they get the IRS to hound people for the Ins Co scum, who exactly do we get to hold them accountable...nobody! What a fuckin sellout.

I am among the many who is happy to eat some crow today. I feared greatly that this effort would come to naught in the aftermath of the Massachusetts election and am absolutely thrilled to be proven wrong! While I do believe that the show of force we liberals made helped stiffen the spine of congress and White House, they still deserve great accolades for seeing this through.

I'm from California. Our budget is always AWFUL because it requires a 2/3 vote. To get the extra votes requires a lot of pork and some atrocious compromises and additions.

I think this reconciliation bill turned out better than what the house-senate conference bill (that would have needed 60 votes) was shaping up as. We can't know for sure, but losing that 60 vote majority might have been a really good thing.

In retrospect, I can see why the President didn't make a huge push in the Chambliss-Martin GA Senate runoff. That was before Specter switched parties, but when it appeared Franken was likely to win his recount to become (at that moment) the potential 59th vote.

With 59 votes, the onus was still on Senate Republicans to provide some minimal support to advance legislation. Once the Democrats got to 60, suddenly McConnell could employ his total unity strategy without major blowback. After all, the Democrats "had a filibuster-proof majority".

The practical effect of this meant that instead of negotiating with Olympia Snowe and Susan Collins for that critical last vote, we had to negotiate with Ben Nelson and Joe Lieberman to hold every last member of the Democratic caucus together. And then if legislation failed, it was blamed on Democrats in-fighting, not Republican obstruction.

If financial reform can't get through, I think it's a lot better to fight the midterms on "Republicans won't stand up to the Banks" rather than "Democrats can't govern".

A small chance, but from the start there was no big effort made against the national Republicans wigging out over a low-turnout runoff.

That aside, my point is that it's arguably easier to govern with 59 Senators than it is with 60. Particularly for the less ideologically-rigid Democrats. (If you had 62, 63 Senators - that's a whole different thing.)

I too must eat some crow today. I was one of the ones that believed the Senate and House versions of HIR were irreconcilable. And that they would never be able to come together over it.

I guess I was right to an extent. Since the House just swallowed the Senate version whole. Then passed some "fixes" using reconciliation; and took a huge leap of faith the Senate would deliver.

But still. In the end, I agree with The President.

"This is not Radical reform. But it is Major reform."

At least that much is true. So, we'll take it.

But the fight for the PO (or something like it) is not over. Now that this Bill has become the Law of the Land, we can start trying to make it better almost immediately.

Well actually I would like to see the poor red states not be able to implement these excellent changes to the insurance rules. I would like to see the poor slobs who vote in these damned evil republicans have to live in a state where children still get denied coverage, and people still get dumped, and all the rest of the misery. Then it would be an education in PROGRESS for them to understand that it is their unending ignorance that keeps us all from simple human decency.

The red states are net collectors of blue state payments to the federal government. I would love to cut off any dollars California has to have extracted from the needs of California to give to the ignorant rednecks in the red states. They lie and smear us and outvote us in the US Senate all so we get the honor of sending them billions in welfare to prop up their evil little republican politicians. Enough!

To really know how HCR will impact each of us we would have to have a crystal ball. I would think I will still have employer provided insurance which will be much the same as it is today. I have pretty good insurance. But, who knows? I could lose my job, get in an accident or be too sick to work, and all of sudden my health insurance wouldn't be there. This reform provides a safety net for could happen at any time to any one of us.

BTW, I do have a college aged child and it's good to know that he won't be without insurance the minute he graduates. So, I know it will be a positive impact for him.

For those of you who have pre-existing conditions, a child with a pre-existing condition, or are sick and concerned the insurance company will drop you, you should be dancing in the streets. Those things are about to change.

they did it with the stimulus, so they probably will with HCR too. Frankly, I don't really care, because the sooner that they accept affordable healthcare coverage as an American right and the law of the land, the sooner all of the repeal bs ends.

and I continue to believe that more progressive improvement such as a PO and Medicare buy-in are now much more likely, and much sooner, than if this bill had not passed.

Funny thing about Health Care Reform. . . the GOP was saying it would be Obama's "Waterloo" if he didn't pass it, and now they are saying it will be his "Waterloo" because he DID pass it, because now it will mean a GOP takeover in November, and/or constitutional challenges.

All their noise is not about Obama or Health Care, it's about their own grasping for power.

Sorry but I have to post this. Feel free to cut and paste into an email and send ti to everyone you know and especially republicans and independents. We need to brag about our accomplishments and educate people before the 2010 elections. People need to know all the good things that happened with the signing of this bill.

Let's start with how health insurance reform will expand and strengthen coverage:

* This year, children with pre-existing conditions can no longer be denied health insurance coverage. Once the new health insurance exchanges begin in the coming years, pre-existing condition discrimination will become a thing of the past for everyone.
* This year, health care plans will allow young people to remain on their parents' insurance policy up until their 26th birthday.
* This year, insurance companies will be banned from dropping people from coverage when they get sick, and they will be banned from implementing lifetime caps on coverage. This year, restrictive annual limits on coverage will be banned for certain plans. Under health insurance reform, Americans will be ensured access to the care they need.
* This year, adults who are uninsured because of pre-existing conditions will have access to affordable insurance through a temporary subsidized high-risk pool.
* In the next fiscal year, the bill increases funding for community health centers, so they can treat nearly double the number of patients over the next five years.
* This year, we'll also establish an independent commission to advise on how best to build the health care workforce and increase the number of nurses, doctors and other professionals to meet our country's needs. Going forward, we will provide $1.5 billion in funding to support the next generation of doctors, nurses and other primary care practitioners -- on top of a $500 million investment from the American Recovery and Reinvestment Act.

Health insurance reform will also curb some of the worst insurance industry practices and strengthen consumer protections:

* This year, this bill creates a new, independent appeals process that ensures consumers in new private plans have access to an effective process to appeal decisions made by their insurer.
* This year, discrimination based on salary will be outlawed. New group health plans will be prohibited from establishing any eligibility rules for health care coverage that discriminate in favor of higher-wage employees.
* Beginning this fiscal year, this bill provides funding to states to help establish offices of health insurance consumer assistance in order to help individuals in the process of filing complaints or appeals against insurance companies.
* Starting January 1, 2011, insurers in the individual and small group market will be required to spend 80 percent of their premium dollars on medical services. Insurers in the large group market will be required to spend 85 percent of their premium dollars on medical services. Any insurers who don't meet those thresholds will be required to provide rebates to their policyholders.
* Starting in 2011, this bill helps states require insurance companies to submit justification for requested premium increases. Any company with excessive or unjustified premium increases may not be able to participate in the new health insurance exchanges.

Reform immediately begins to lower health care costs for American families and small businesses:

* This year, small businesses that choose to offer coverage will begin to receive tax credits of up to 35 percent of premiums to help make employee coverage more affordable.
* This year, new private plans will be required to provide free preventive care: no co-payments and no deductibles for preventive services. And beginning January 1, 2011, Medicare will do the same.
* This year, this bill will provide help for early retirees by creating a temporary re-insurance program to help offset the costs of expensive premiums for employers and retirees age 55-64.
* This year, this bill starts to close the Medicare Part D 'donut hole' by providing a $250 rebate to Medicare beneficiaries who hit the gap in prescription drug coverage. And beginning in 2011, the bill institutes a 50% discount on prescription drugs in the 'donut hole.'

Not sure if this is the right forum, but...

When they say dependents can remain covered under the parents' plan, does that mean via COBRA or does the employer have to let the dependent stay on the plan until age 27? Its a question here at work and I don't have the answer.

From what I understand, the insurance company must let the dependent stay on the parents plan until age 26 (not 27). I don't think Cobra has anything to do with it.
