
Former Rep. J.D. Hayworth (R-AZ), who is challenging Sen. John McCain in the August 24 primary, has explained another reason to repeal birthright citizenship for all people born in the United States: That "birth tourism" is resulting in people around the world timing their pregnancies so that births coincide with visits to America.
During an appearance this morning on MSNBC, Hayworth said: "It's not exclusive to our neighbors to the south, from Mexico. Many families around the world in the jet age are timing the gestation period to come to the United States, to have the blessed event here, so that the new birthright citizen will have access to a phalanx of American benefits, courtesy of you and me and other American taxpayers."
An ABC News story earlier this year reported that actual birth tourism does exist as a real phenomenon -- separate from the issue of the children of illegal immigrants -- but accounts for perhaps only a few thousand births per year. Given the costs involved, these would probably be the children of well-off families who would likely not require financial benefits of American citizenship, but would be seeking such a thing more from a legal standpoint.
The TPM Poll Average shows McCain leading Hayworth by 53.6%-32.1%.
Birthright citizenship is a legal principle based in the 14th Amendment: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside." In the absence of birthright citizenship, it is possible for people to be born without having citizenship in any country at all, due to failure to meet some extra requirement that could be imposed, such as ancestry or other circumstances.
During his appearance, Hayworth added: "The original intent of the 14th Amendment, as offered by Sen. Jacob Howard, dealt with the clause 'subject to the jurisdiction thereof.' In his floor speech, Sen. Howard made it very clear that diplomats nor aliens, were subject to the jurisdiction of the United States. Ergo, their children would not have birthright citizenship."
The quote from Sen. Howard is a bit more ambiguous than that: "This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the government of the United States, but will include every other class of person." It's unclear whether Howard was referring to different categories of people, or a single category or foreigners who belong to the families of ambassadors. At any rate, courts have historically interpreted the clause in its most broad fashion.
Hayworth is not the only conservative to oppose birthright citizenship -- nor to provide some interesting reasons why. A month ago, Rep. Louie Gohmert (R-TX) warned of a diabolical 30-year plot by some very patient terrorists, in a speech on the House floor: "I talked to a retired FBI agent who said that one of the things they were looking at were terrorist cells overseas who had figured out how to game our system. And it appeared they would have young women, who became pregnant, would get them into the United States to have a baby. They wouldn't even have to pay anything for the baby. And then they would turn back where they could be raised and coddled as future terrorists. And then one day, twenty, thirty years down the road, they can be sent in to help destroy our way of life."

I tried for a very long time to convince myself it would be OK if Hayworth beat McCain in the primary, since such an event would effectively hand the election to Democrats. But that smirk on Hayworth's face has made me realize that I just couldn't stand anything that brings happiness to Hayworth.

While I do think JD Hayworth is a looney toon, he is sort of correct on this issue.
There is a booming birth tourist trade on the west coast. Primarily CA and WA. Where woman, usually 7 months pregnant come to the US to give birth at a host home and then fly back to their native country. I know this for fact. I personally know a family from Taiwan who has done this twice. As recently as 2 months ago.
However, it is not a Mexican phenomena. It is primarily an Asian thing. Mostly middle-upper income woman from Taiwan, Korea, The Philippines and China. The woman from Taiwan and Korea do it out of fear of conflict and future education. The Philippines for economic reasons. And China? Well, they're a problem. Their motives for having American born Chinese citizens should be a very big concern. By far, the Chinese are doing this more so than any other nation.

I would ask for a bit more evidence of the "booming" birth tourism you describe you know "for a fact" is happening. Anecdotes of a family you know of doing it twice isn't good enough. And I'm not sure what I'm missing, but why should we be particularly concerned about Chinese women doing this? Why would their motives be any different that those you ascribe to Taiwanese and other women?

I am as liberal as the day is long. I'm not passing judgment on the practice. I'm only confirming that there is a booming trade in the practice. I've been doing business in Asia for 25 years. I lived in Japan for 4 years. I spend more than 3 months over the course of any given year, in Taiwan. My wife is American born Taiwanese. While I am not Asian, I have extensive family ties in Taiwan.
I know what I am talking about. It is far more common among the upper middle class of Taiwan, Korea and the Philippines than you may think. It is considered somewhat of a status symbol as well. As I said, the Taiwanese and Koreans who do this, do so because of future uncertainty. Or at least that's what they say. It is not a common practice with the Japanese.
They do not do it for the reasons that JD Hayworth is trying to scare people about. They are not doing it for our free services. But it is being done in an semi-organized way.
On the west coast, families rent out "host homes" where 3 or more pregnant woman at a time will live until they give birth. Kind of like a hostel for pregnant woman. There is an entire network of these "pregnancy hostels" throughout CA and WA. A few weeks after they give birth, they go back home with a child with an American passport. Maybe that child comes back to the US. Maybe they don't. It is a parent's hedge against an uncertain future for their children.
As for the PROC, pregnant woman don't leave China unless the government approves. The children born here are euphemistically referred to as ABC kids. American Born Chinese. The concern, expressed by those in Taiwan is that select numbers of the PROC children will eventually come back to the US for advanced education, get jobs in high tech industries and transfer technologies back to the PROC.
Whether that happens remains to be seen. But it is not beyond the realm of possibility based on how things work in China.

In a peculiar way, this shows exactly how much the anti-immigrant hysteria on the right is based on pure racism as opposed to what one might consider to be more legitimate concerns like financial support of indigent aliens.
I find the idea that it would be a bad thing to have affluent people from places like Taiwan who are concerned about their children having citizenship in a free country fly here to give birth and create a connection with the United States to be just strange.

Excellent point, Bart. If a family is well-off, educated, etc. and chooses to come here for the birth of their child, I'm not seeing the problem. So long as we're not *selling* citizenship and the non-native family members would still have to go the traditional route to becoming Americans (or so long as they followed the procedure to be and stay resident aliens), I'm not seeing the problem.
IIRC, P. J. O'Rourke said something similar when he once observed that some Cubans were willing to paddle leaky life rafts 90 miles through shark-infested waters just so they could have a crack at serving Cuba Libres to fat tourists or doing housekeeping work in hotels in Miami. Those are the sorts of determined, hardworking people, he said, that a country should *want* to accept as citizens.

If they're not subject to laws, they don't go to jail at all - diplomats get off scot-free for minor offenses, and get expelled with no punishment for major ones like killing someone. That's what you're proposing for everyone, but you and Hayworth seem to be too dumb to realize it.

If you're against progressive ideas, you're against the Civil Rights amendment, against giving women the right to vote, and against pure food and drugs being certified by the US government. But since you equate socialism with progressives, you don't really have a clue about what you spew, and you mindlessly follow Fox talking points because they make you sound smart to yourself. I don't want to agree with him, but I did read something some years back about how women from Hong Kong before 1997, came here to have their babies so that they could have an anchor here just in case China decided to be a bit opressive when they took the island over. But of course they didn't because Hong Kong is a cash cow. I also read that South Korean woman did the same thing just in case Kim Jonk Ill got a itchy trigger finger.

Ya, morons, anchor babies work!! Not. A citizen cannot sponsor family members to be legal immigrants in the US until they're 21 years old. Big deal. 21 years later you can have your kid sponsor you, which is another 5-7 year wait if you weren't born in China, Mexico, or India, in which case it's 10 years or more. uh huh. anchor babies.

I'm not sure attacking Hayworth for this is valid. The Washington Post reported 10 days that Chinese-Americans were bringing wealthy pregnant Chinese women to the US so their children can have dual citizenship:

The reality is that a) these people are not going to be drags on the economy; b) their children will be eligible to go to college here, a real advantage compared with their peers in China; and c) it's not clear this is something we should or shouldn't be concerned with. I am as liberal as the day is long. I'm not passing judgment on the practice. I'm only confirming that there is a booming trade in the practice. I've been doing business in Asia for 25 years. I lived in Japan for 4 years. I spend more than 3 months over the course of any given year, in Taiwan. My wife is American born Taiwanese. While I am not Asian, I have extensive family ties in Taiwan.
I know what I am talking about. It is far more common among the upper middle class of Taiwan, Korea and the Philippines than you may think. It is considered somewhat of a status symbol as well. As I said, the Taiwanese and Koreans who do this, do so because of future uncertainty. Or at least that's what they say. It is not a common practice with the Japanese.
They do not do it for the reasons that JD Hayworth is trying to scare people about. They are not doing it for our free services. But it is being done in an semi-organized way.
On the west coast, families rent out "host homes" where 3 or more pregnant woman at a time will live until they give birth. Kind of like a hostel for pregnant woman. There is an entire network of these "pregnancy hostels" throughout CA and WA. A few weeks after they give birth, they go back home with a child with an American passport. Maybe that child comes back to the US. Maybe they don't. It is a parent's hedge against an uncertain future for their children.
As for the PROC, pregnant woman don't leave China unless the government approves. The children born here are euphemistically referred to as ABC kids. American Born Chinese. The concern, expressed by those in Taiwan is that select numbers of the PROC children will eventually come back to the US for advanced education, get jobs in high tech industries and transfer technologies back to the PROC.
Whether that happens remains to be seen. But it is not beyond the realm of possibility based on how things work in China.
