
A federal judge today blocked several parts of Arizona's new immigration law, putting them on hold as the overall law was scheduled to take effect Thursday.
U.S. District Judge Susan Bolton ruled that the portions of the law that most angered its opponents -- including the checking of immigration status during stops for unrelated offenses -- would not be allowed to be enforced. The Associated Press reported that the sections would be put on hold until the courts resolve the issues. White House spokesman Bill Burton told reporters on Air Force one that the Department of Justice would be reacting to the ruling.
Judge Bolton was appointed by President Bill Clinton. She was assigned the seven lawsuits filed against the Arizona measure, which has ignited protests, boycotts and even a scolding from officials in Mexico.
Bolton rules, "There is a substantial likelihood that officers will wrongfully arrest legal resident aliens under the new [law]. ... By enforcing this statute, Arizona would impose a 'distinct, unusual and extraordinary' burden on legal resident aliens that only the federal government has the authority to impose."
The law has acted as a flashpoint in the long-standing debate over immigration, and sparked new discussions about efforts to pass a comprehensive immigration plan in Congress. (The chance of passing comprehensive immigration reform in an election year is highly unlikely.)

Gov. Jan Brewer this afternoon said she would appeal the ruling and called it "a little bump in the road." Brewer (R) suggested that it's just a temporary glitch and that both sides knew the other would appeal no matter what. Watch her full comments to reporters here.
She said the federal government must "step up ... and do the job that they have the responsibility to do for the people of America and the people of Arizona."

The judge also put on hold parts of the law that required immigrants to carry their papers at all times, and made it illegal for undocumented workers to solicit employment in public places....
The ruling came just as police were making last-minute preparations to begin enforcement of the law at 12:01 a.m. Thursday and protesters were planning a large demonstrations to speak out against the measure. At least one group planned to block access to federal offices, daring officers to ask them their immigration status.
Late Update: Homeland Security's deputy press secretary Matt Chandler issued a statement on the ruling:
The court's decision to enjoin most of SB1070 correctly affirms the federal government's responsibilities in enforcing our nation's immigration laws. Over the past eighteen months, this Administration has dedicated unprecedented resources to secure the border, and we will continue to work to take decisive action to disrupt criminal organizations and the networks they exploit. DHS will enforce federal immigration laws in Arizona and around the country in smart, effective ways that focus our resources on criminal aliens who pose a public safety threat and employers who knowingly hire illegal labor, as well as continue to secure our border.ICE works everyday with local law enforcement across the country to assist them in making their communities safer and we will continue do so in Arizona. At the same time, we will continue to increase resources in Arizona by complementing the National Guard deployment set to begin on Aug. 1 with the deployment of hundreds of additional Immigration and Customs Enforcement agents, Border Patrol agents and other law enforcement personnel that will aid in our continuing efforts to conduct outbound inspections, patrol challenging terrain, and interdict illicit smugglers. We are focused on smart effective immigration and border enforcement while we work with Congress toward the type of bipartisan comprehensive reform that will provide true security and establish accountability and responsibility in our immigration system at the national level.

She just did this for politics and not because of things like the impact of the fed's policies on her state's levels of crime (which doesn't just affect the border region but the whole country; what happens on the border doesn't stay there), spending, school overcrowding, and others; the possibility that some local officials have been compromised by criminals; the fact that crooked businesses are trying to profit from illegal activity; the fact that the feds have in effect ceded control of part of our country to foreign criminals; and so on.
It has nothing to do with that!
P.S. Per CBS, 74% support AZ's law (those who support it + those who think it doesn't go far enough = 74%).

Yes and no. Perhaps they weren't trying specifically for the midterms, but most of these laws and regulations that get passed although blatantly unconstitutional are put through as ritual performances -- to signal allegiances and give people something to rally around.

Now that she's gotten rid of the illegal portions, there's still one cause for concern: she left in the part allowing people to sue the police if they feel that they are not enforcing immigration laws "to the fullest extent." Even if the suits from the right-wing "DEPORT THEM ALL" blowhards have less of a legal leg to stand on, they'll still cost the police departments money. Yet if they "enforced the laws" to the extent the blowhards want, they'll be (rightly) sued for human rights violations. Not something a cash-strapped civil service needs.

Interesting.
Theres a piece over at Salon about how the DOJ F'ed up this case. The DOJ argued that the ENTIRE law had pre-emption issues. What Arizona smartly argued was that SB 1070 was considred in the context of illegal immigration being a "local" issue. It is a local issue because it is local governments that bear the implications of this issue.
Thus, the portions of the law that were most noxious and bigoted were the ones put on hold.
My guess it's the following:
The section about illegal people solicitng work can be remedied with a local ordinance banning loitering.
The section about immigrants having to carry thri papers at all times... this I don't know. There might be pre-emption issues with this section since it's already a federal law.
The section about "reasonable suspision" of someone being an illegal immigrant is the most laughably racist thing about this law. It'll be a a cold day in hell when this is considered constitutional; i.e., unless Judge Tancredo gets this case on appeal.
All in all: Thank you ACLU. No thanks DOJ. And no, I will not be taking my US Passport to verify my legal Latino ass. They can try to deport me to California first.

My father used to run a residential framing company before the collapse. He once tried to hire all union carpenters to work for him.
He couldn't afford to. Why? Because the home builders weren't willing to pay enough for the work. Why weren't they willing to pay enough?
Because people weren't willing to pay enough to buy the houses if they used all legal (let alone union) labor.
We have only ourselves to blame for illegal immigrant labor. We're not willing to pay what it takes to keep Americans who want to 'live the American' dream employed. Unless we want a whole, rather large segment of our population to live below what is considered the poverty line.

rather than unloading on undocumented persons - many of whom come here for the same reasons virtually all the ancestors of people in this country did, to escape persecution and/or seek a better life - how about going after the activist Supreme Court, circa 2002, when they ruled that undocumented workers who were illegally fired for labor activity were not allowed to get back pay?
All of a sudden, it became a lot easier for employers to hire undocumented workers and get rid of them if they started to complain about little things like fair wages . . . with no financial consequences to the employer.
If employers had to treat undocumented workers the same way - and couldn't benefit, financially, from anti-union activity, etc, by these kinds of stunts, there would be a more level playing field for all workers. THAT's a big part of the problem.

Why do you, and others like you, think that immigrants (illegal or otherwise) somehow have it easy in America.
My grandparents immigrated here 80 years ago and people were so upset that they invoked laws prohibiting them from buying land. I guess the bigots in 1910 didn't think of making their very existence illegal back then.
The people that you have such hatred and fear are just like all of our ancestors who came here looking for a better life for their children. And like our ancestors, are being greeted with hatred and fear.
The only difference is that today, we are calling them illegal and are trying to prevent them from being here.
If these attitudes and laws were invoked 80 years ago, I wouldn't be here and neither would most people in this country.
It's simply wrong to institutionalize hatred like these laws do and hiding your racism with the veil of law is an embarrassment and the antithesis of everything this country was founded upon.

I do not think illegals are scum. Most come here and work hard trying to make a better life for themselves. Hell, I guess you could say even the drug cartels are trying to make a better life for themselves. But I also think that the U.S. has a right, as does every other country, to enforce it's borders and have a procedure that needs to be followed in order to immigrate legally.

The part I don't understand is why we would expect officers to only wrongfully arrest legal resident aliens.
If you are a citizen, you obviously have no immigration papers - so if the officer has "suspicion" about the immigration status of a citizen I would expect that citizen will be arrested. No?

Yes. On NPR I heard a story a couple of weeks ago about a Latino family where the daughters -- one about 20 the other about 16 -- were going to drive to college in Arizona. The car was stopped in Arizona and the girls were asked for their ID. Older one had it, younger one didn't have a drivers license or anything else. Citizens both. Parents had to jump through hoops to get the younger one released.

And by the way legal resident aliens are required to carry their registration card per United States Code: TITLE 8 > CHAPTER 12 > SUBCHAPTER II > Part VII > § 1304
(e) Personal possession of registration or receipt card; penalties
Every alien, eighteen years of age and over, shall at all times carry with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him pursuant to subsection (d) of this section. Any alien who fails to comply with the provisions of this subsection shall be guilty of a misdemeanor and shall upon conviction for each offense be fined not to exceed $100 or be imprisoned not more than thirty days, or both.

Lots of folks with disabilities don't have licenses or ID's and might not be able to lay their hands on a birth certificate at the drop of a hat. Battered women fleeing their abusers, kids pulled out of violent homes - they don't always stop and pick up ID along the way. homeless folks. And so on.

Here's the deal. Say a legal resident alien is pulled over for a malfunctioning tail light. If they supply the proper documents for driving, i.e. driver license, proof of insurance, they will be issued a fix it ticket and be able to go on their merry way. Why is that such a burden?

You should read the opinion. The rationale is not merely that it is a burden; that's just what this story makes it sound like. The opinion explains that the Constitution gives the federal government *exclusive* control over immigration and naturalization, and that there is a long history of the federal government refusing to require legal residents to carry papers. The federal government gets to make the call about carrying papers, and it has done so: legal residents are not required to carry papers. Because federal power over that issue is exclusive, Arizona has no constitutional power to legislate on the topic.

Senator Harry Reid, the majority leader in the close knit pack of Democrats, believes he is getting bad polling numbers, owing to the ingress of new residents that don't know him. Unfortunately he's right, as a great majority of the new arrivals over the last five years were illegal aliens, taking construction jobs in the once thriving building boom. Now with the economic downturn, the building industry has faded out, after the greedy grasping of cheap labor by construction owners. Now out of work illegal immigrants unable to find work, are suffocating the welfare offices and that the reason the state of Nevada is hurting economically. The illegal alien invasion has not gone away and have infiltrated more than ever, in the casinos and entertainment-service industry as a whole. While Americans and legal residents remain jobless, illegal immigrants have transferred to those positions at lower wages.
In any midterm elections or November, we must be careful to watch for irregularities in Nevada, but across the wide spectrum of polling places in this country. Only a few states have strict regulations on federal voting rules and absentee ballots little or none. Absentee voting is especially opened to fraud, and incumbent politicians with their careers on the line have much to lose. If a person (s) have criminally penetrated America, without being processed, it is my belief that many illegal entrants will break the law further by voting for pro-amnesty afficiardo's like Sen. Reid? Citizenship is and should be a basic requirement for voting. Citizenship is a legal requirement to vote in federal and state elections, except for a small number of local elections in a few jurisdictions. Non-citizen voting is likely growing at the same rate as the alien population in the country; but because of deficiencies in state law and the failure of federal agencies to comply with federal law, there are almost no procedures in place that allow election officials to detect, deter, and prevent non-citizens from registering and voting. Instead, officials are largely dependent on an “honor system” that expects aliens to follow the law. There are numerous cases showing the failure of this honor system.
Here are some excerpts from eyewitness accounts and summaries of foreign nationals voting in federal elections
In California, as an example former Republican Rep. Robert K. Dornan was defeated by Democrat Loretta Sanchez by 984 votes in the 1996 election. State officials found that at least 300 votes were cast illegally by non-citizens. Honolulu Advertiser, September 9, 2000. Election officials found 543 Oahu residents who were not U.S. citizens had registered to vote.
In 1996, Congress enacted the Illegal Immigration Reform and Immigrant Responsibility Act, making it a federal crime for non-citizens to vote in any federal election (or state election, unless authorized by state law). As a penalty, ineligible non-citizens who knowingly vote may be deported. Additionally, a non-citizen who falsely claims to be a United States citizen is in violation of this law. In 1997, the FBI and the U.S. Attorney’s office in Dallas were investigating voting by non-citizens. They sent a computerized tape of the names of individuals who had voted to the INS requesting a check against INS records, but the INS refused to cooperate with the criminal investigation. An INS official was quoted as saying that the INS bureaucracy did not “want to open a Pandora’s Box…. If word got out that this is a substantial problem, it could tie up all sorts of manpower. There might be a few thou sand [illegal voters] in Dallas, for example, but there could be tens of thousands in places like New York, Chicago or Miami.”

We must eye incumbent elections, that a few hundred votes could put a bad politician back in office, such as Sen. Harry Reid. Your vote is important to Washington’s Senate and Congressman, so bombard them that you are adamantly against any type of Amnesty. Justice Alito is addressing the issue of deporting aliens, no where in SB 1070 mentions anything about deporting illegal aliens, only turning them over to DHS or ICE for processing.
Judge Bolton has made a ruling based on issue where it doesn't exist, "deporting aliens"...this can not stand constitutional muster and should be overruled at a higher court.

Being a student of the Holocaust, all I can say is WOW - the extreme right-wing discourse sounds a LOT like that of the Nazis and their sympathizers in 1930s Germany. I hope we don't start hearing dehumanizing words like "vermin." Seriously, read about the years leading up to the Holocaust. Frightening and looking a bit like 2010 America. I pray we as a nation never get that far. But I fear that if the teabaggers gain power that it would only be a matter of time.

As a citizen I would expect that if I violate the law there could be consequences.
When the illegal violates the law, they claim discrimination or they run from the law, finding a new false identification.
Here in Phoenix, there are a large number, of hit and run accidents.
How can an officer track down an unknown ILLEGAL; who flees across the border, which can get another ID?
A new ID, stealing another’s SS#, causing havoc with the legal citizens credit, a legal citizen called before the IRS, to explain unreported income, because someone illegal stole your SS#.
I suppose you think this is only a slight inconvenience?
Sure the illegal pays taxes, if only they are withheld.
Most of the time they are in the underground economy.
Employer likes paying cash, the illegal likes cash, until they can't find work and they'll stand in line for welfare.

Brewer was not elected, she filled the vacancy left by Napolitano leaving to become Secretary of Homeland Security and Arizona does not have a lieutenant governor position. And now Arizona is going to use money it does not have to fight a law that is unconstitutional...so far, smart moves are not in Brewer's or the Arizona state legislature's repertoires. I sure hope that the AG, Terry Goddard is elected as governor...maybe sanity will occupy the state house once again...at the very least with Goddard the IQ of the governor will rise precipitously. Brewer could then go back her home state of California to do some bashing of "illegals."
Why is the blame placed on the migrant workers (goes without saying that many posters herein see all Hispanics as potentially illegal) for the construction day labor work going to them? Why not place it on the fact that Arizona has always been a "right to work" state so unions are hamstrung in that state. Construction, especially residential construction, uses the cheapest labor it can to maximize the profit per unit. In addition, many of the major hotels and resorts employ cheap labor to clean their rooms, cook their food, keep up their grounds, and curry their golf courses...all temporary, part-time, hourly labor without benefits and that has been going on forever in Arizona!!! And, by the way, Arizona was part of Atzlan long before it became a state in 1912 (Feb 14) and over 1/5 of the population are native Spanish-speakers. To date, it is estimated that more than 250,000 Hispanic people have left Arizona for other states. Some may say good riddance but I say that is one heckuva tax base to lose. This is not to say that there is not a problem in Arizona but throwing the baby out with the bathwater or creating a Wild West police state are not solutions.
